Importer Security Filing: the 10 plus 2 data ocean shipments live or die on

The importer's ten cover the parties and the goods: manufacturer or supplier, seller, buyer, ship to party, importer of record number, consignee number, country of origin, the commodity's HTSUS number to six digits, the container stuffing location, and the consolidator. No single desk in most companies holds all ten. The purchase order has some, the supplier has the stuffing location, the broker assembles the rest, which is why ISF is a coordination problem before it is a filing problem.

The ten elements, and who actually holds them

Two elements, manufacturer and stuffing location among them, are the chronic latecomers because they are only final when the container is actually loaded. The rules allow updating certain elements after the initial filing within set windows. Build your process around that: file what is firm on time, update what legitimately firms up later, and record both.

Teams miss ISF deadlines by counting from the wrong event. The clock runs to the loading of the cargo onto the vessel at the foreign port, and the forwarder's cut off for ISF data is earlier still. An internal deadline that gives the broker the data a full day before the carrier cut off absorbs the inevitable missing element without drama.

Timing is measured from lading, not sailing

Penalties for late or inaccurate filings are assessed per filing, and a pattern of lateness is visible to CBP in a way a single miss is not. Importers with clean filing histories feel the difference across every part of the relationship, from exam rates to how much benefit of the doubt an error gets.

ISF data does not vanish once the ship sails. It is compared against the bill of lading and the entry, and mismatches between what was filed for security and what is later declared for duty ask their own questions. A supplier name improvised for the ISF and corrected silently on the entry is a discrepancy with your name on both ends.

Accuracy is checked against the entry later

Keep the source documents behind each element. When a mismatch query arrives months later, the purchase order, packing list, and supplier correspondence that fed the filing are the answer. A broker's portal printout alone shows what was sent, not why it was right.

Most importers file through their customs broker or forwarder under a power of attorney, but the legal responsibility stays with the importer of record. Outsourcing the keystrokes does not outsource the penalty. Confirm with your licensed customs broker who transmits, what their data cut off is per port, and how updates and amendments are handled, before the first booking, not during the first missed sailing.

Who files, and what to confirm with your broker

Bond coverage is part of the same conversation: ISF requires bond backing, either within a continuous bond or separately. A new importer whose bond was arranged for entries alone can discover the gap at the worst moment, with cargo waiting on a dock overseas.

Frequently asked questions

What is the UFLPA rebuttable presumption?

Ten data elements supplied by the importer or its agent, covering parties, origin, commodity, stuffing location, and consolidator, plus two from the carrier: the vessel stow plan and container status messages. Together they form the Importer Security Filing for US vessel cargo.

What evidence does CBP accept to release a detained shipment?

Generally 24 hours before the cargo is laden aboard the vessel at the foreign port for most elements, with limited flexibility to update certain elements afterward. Your forwarder's data cut off will be earlier, so internal deadlines should be set from that, not from the regulation alone.

Which products face the highest detention risk?

No. ISF applies to vessel shipments. Air and other modes have their own advance data requirements, but the 10 plus 2 filing itself is an ocean cargo rule, which is why a mode switch mid order can change the filing picture completely.

Can a small DTC brand realistically do supply chain tracing?

The importer of record carries the liability for penalties, even when an agent transmits the filing. Choose the filer deliberately, agree cut offs in writing, and keep your own record of when complete data was handed over.
